THE QUEEN’S AND LORD TREASURER’S REMEMBRANCER (QLTR)

ASSET REGISTER OF HERITABLE PROPERTY HAVING FALLEN TO THE CROWN

The property on this register is land, buildings or other heritable property that has fallen to the Crown as bona vacantia (Latin for ownerless property) or ultimus haeres (an estate where a person has died without a will and no known relatives).  It is normally the case that bona vacantia property is brought to the QLTR’s attention as having fallen to the Crown by someone who is interested in acquiring it.

Please note:

1. Despite a property being on this register, the QLTR does not undertake to deal with it.  If the property fell to the Crown at common law the QLTR has the discretion to decide not to deal with it.  The QLTR may therefore do nothing in relation to the property.  If the property belonged to a dissolved company (or other body such as a limited liability partnership to which the companies regime has been applied) and therefore fell to the Crown under statute, the relevant legislation provides the QLTR with a statutory discretion to disclaim such property.  The QLTR’s discretion to disclaim property on this register is therefore reserved.

2. A property being shown on this register, does not mean that the Crown has entered into possession of it, and accordingly the Crown may still be exempt from liability in reparation pursuant to section 40(4) of the Crown Proceedings Act 1947.

3. The properties included in this register are ones that the QLTR has not yet disposed of (or disclaimed should she subsequently decide to disclaim a property).  However, a disposal may already be in progress as a purchaser may have already indicated to her that it wishes an opportunity to acquire the property for an agreed amount or missives for a disposal may already have been concluded.  (As a matter of practice the QLTR will not normally enter into missives except where an offer has been made for property following marketing on the open market or competitive bids between various interested parties have been sought).

Disposal in Progress” in this register identifies the properties where a disposal is under active consideration with interested parties and no further approach will be considered in respect of any such property unless a disposal pursuant to that fails to proceed. It does not mean that the QLTR has yet entered into possession of the subjects concerned.
